1. About these terms
These terms apply to the use of this website and enquiries submitted to Gourav Bagora. Submitting a form, calling or sending a message does not by itself create a service contract or guarantee availability.
A project begins only after the scope, price, responsibilities and payment arrangement have been confirmed in writing. If an accepted proposal, statement of work or invoice conflicts with these general terms, the project-specific document will control for that project.
2. Packages, estimates and taxes
Published package prices apply only to the scope described beside them. “Starting from” prices are indicative and may change when the requested features, content, integrations, platforms or delivery requirements are different.
- Prices on the India landing pages are inclusive of GST where the page expressly says “GST included”.
- Domain registration, website hosting, Apple or Google developer accounts, paid themes, plugins, APIs, messaging, payment gateways and other third-party charges are separate unless expressly included.
- A written estimate may expire if it is not accepted within the period shown on it.
3. Timelines and “ready” dates
Published timelines are good-faith estimates for the stated scope. A “ready” or “build ready” date means the agreed build is ready for review or submission—not that a third party has completed approval, indexing or publication.
Delivery dates may move when content, credentials, decisions, feedback or payments are delayed; when scope changes; or when third-party platforms experience delays. Any material change will be communicated as early as reasonably possible.
4. Your responsibilities
You agree to provide accurate requirements, timely feedback, necessary account access and content that you have the right to use. You are responsible for reviewing and approving text, prices, legal claims, images and business information before launch.
You must not request or use the services for unlawful, deceptive, infringing, abusive or harmful activity. Gourav may refuse or stop work that creates a legal, security or ethical risk.
5. Scope, revisions and changes
The agreed scope and included revision rounds will be stated in the proposal or package description. Reasonable corrections within that scope are included. New pages, features, integrations, platforms or substantial changes in direction may require a revised timeline and additional fee, which will be agreed before the extra work begins.
6. Payment, cancellation and refunds
Payment milestones and due dates are confirmed before work starts. Work may be paused if a payment is overdue.
Because project time is reserved and the work is customised, amounts paid for completed work, approved milestones or time already reserved and used are normally non-refundable, subject to applicable law. If a project is cancelled, you remain responsible for work completed and committed third-party costs up to the cancellation date. Any different refund or cancellation arrangement in the accepted proposal will apply.
7. Ownership and licences
After full payment, you receive the rights to the final custom deliverables stated in the proposal. Gourav retains ownership of pre-existing tools, reusable methods, general-purpose components, know-how and materials not created exclusively for your project, while granting the licence needed to use the delivered project.
Open-source software, fonts, stock media, platforms, plugins and other third-party materials remain subject to their own licences and terms. Drafts, unused concepts and unpaid work remain the property of their respective owner.
8. Launch, support and maintenance
Any included launch-support period covers reasonable fixes for the agreed delivered scope. New features, content changes, third-party failures, account problems, security incidents caused by changed credentials or outside modifications, and ongoing maintenance are separate unless expressly included.
Hosting, domains, app-store accounts and other business accounts should remain in your name wherever practical. You are responsible for renewals and third-party fees after handover.
9. Third-party results and warranties
Services are provided with reasonable care and skill. However, no guarantee is made regarding Google rankings, advertising performance, lead volume, revenue, uninterrupted hosting, third-party API availability, app-store approval or a particular business outcome.
Third-party platforms make their own decisions and may change their rules, prices or services without notice. To the maximum extent permitted by law, implied warranties not expressly stated in an accepted project agreement are excluded.
10. Liability
To the maximum extent permitted by law, neither party will be liable for indirect, special or consequential losses such as lost profits, lost data or lost business opportunity. Gourav’s total liability arising from a service will not exceed the amount paid for the specific service giving rise to the claim, except where applicable law does not allow that limitation.
11. Ending an engagement
Either party may end a project according to the accepted proposal or where the other party materially breaches the agreement and does not correct the breach after reasonable notice. On termination, outstanding fees for completed work and committed costs become due. Handover of usable completed work is subject to payment of those amounts.
12. Governing law and contact
These terms are governed by the laws of India. Subject to applicable consumer rights and mandatory law, disputes will be handled by courts with competent jurisdiction in Rajasthan, India. The parties should first attempt to resolve concerns directly and in good faith.
